Software License Agreement

This is a legal agreement between you (either an individual or an entity) and Sygyt Software UG (haftungsbeschränkt), Am Langen Seil 113, 44799 Bochum, Germany, concerning the licensing of the software application called either “Overtone Analyzer” or “VoceVista Video” (henceforth “The Software”). By using the Software, you agree to be bound by the terms of this agreement.

Grant of License

This License Agreement permits you to install and use copies of the Software product identified above. The Software is licensed to a specified number of users, or as a Site License for an unlimited number of users at a single physical location. This Agreement requires that each user of the Software be licensed, either individually, or as part of a multi-user license. Each licensed user may install and use the Software on more than one computer, provided that the total number of users does not exceed the number of users allowed by your license.

The Software is owned by Sygyt Software and is protected by international copyright laws. You must not redistribute the software files or license keys in any form unless you transfer your rights under this license on a permanent basis.

Other Restrictions

You may not distribute, rent, loan, sublicense, or lease the Software. However, you may transfer your rights under this license on a permanent basis, provided you transfer this License, the Software, any license keys, and all accompanying materials, retain no copies, and the recipient agrees to the terms of this License.

Limited Warranty

Sygyt Software warrants that the Software will perform substantially in accordance with the accompanying documentation for a period of 12 months from the date of receipt.
The entire liability of Sygyt Software and your exclusive remedy shall be, at the option of Sygyt Software, either (a) return of the price paid or (b) repair or replacement of the Software that does not meet this Limited Warranty and that is returned to Sygyt Software with a copy of your receipt.
This Limited Warranty is void if failure of the Software has resulted from accident, abuse, or misapplication. Any replacement Software will be warranted for the remainder of the original warranty period.

To the maximum extent permitted by applicable law, Sygyt Software disclaims all other warranties, either expressed or implied, with respect to the Software and its documentation.

No Liability for Damages

In no event shall Sygyt Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, bodily harm, damages for loss of business profits, business interruption, loss of information, or any other pecuniary loss) arising out of the use of or inability to use the Software, even if Sygyt Software is aware of the possibility of such damages and known defects.
